Last updated: October 8, 2026

These Terms of Use govern access to and use of barker-barker.com and its subdomains. They do not govern consulting engagements. Consulting engagements are governed by separately signed engagement agreements.

2. Scope of these Terms

These Terms govern your access to and use of the Site. They do not govern consulting engagements between Barker and Barker Consulting and its clients. Consulting engagements are governed by separately signed engagement agreements. In the event of a conflict between these Terms and an engagement agreement, the engagement agreement controls with respect to the engagement.

Certain functionality on the Site (Engage forms, Capability Statement download, newsletter subscription, downloadable content, embedded video) may be subject to additional terms disclosed at the point of use. Those additional terms are incorporated into these Terms by reference.

3. Permitted use

  • Submitting Engage form inquiries, subscribing to the newsletter, and requesting content packets.
  • Sharing links to Site pages through email, social media, and other lawful sharing mechanisms.
  • Citing Site content in academic, journalistic, and professional works with attribution to Barker and Barker Consulting.

4. Prohibited use

  • Do not use the Site for any purpose that violates applicable law, including U.S. federal, state, or local law, or the law of any jurisdiction you access the Site from.
  • Do not attempt to gain unauthorized access to the Site, to any server or infrastructure on which the Site runs, or to any user account maintained by the firm or its service providers.
  • Do not attempt to interfere with the operation of the Site, including by transmitting malware, launching denial-of-service attacks, or exploiting security vulnerabilities.
  • Do not scrape, crawl, or mass-download the Site for purposes of building a competing product or dataset, including for use in training machine-learning models, without the firm's prior written authorization. Individual browsing, standard search-engine indexing, and reasonable citation are permitted.

  • Do not reproduce Site content on a competing consulting-firm website, whether in whole or in adapted form, without prior written authorization from the firm.

5. Intellectual property

5a. Site content

All content published on the Site, including text, graphics, images, logos, icons, audio, video, downloadable files, and the arrangement and design of the Site, is the property of Barker and Barker Consulting or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

Except as expressly permitted by these Terms or by additional terms disclosed at the point of use, no content published on the Site may be reproduced, distributed, publicly performed, publicly displayed, adapted, or used to create derivative works without prior written authorization from Barker and Barker Consulting.

5b. Fair use, citation, and attribution

The firm authorizes limited citation and quotation of Site content in academic, journalistic, and professional works consistent with the fair-use provisions of U.S. copyright law, provided:

  • The citation includes clear attribution to Barker and Barker Consulting.
  • The quoted material is not the entirety or substantially the entirety of a briefing, past-performance page, or capability page.
  • The citation does not present the quoted material in a way that distorts its meaning or falsely attributes positions to the firm.

5c. Trademarks

5d. User submissions

Information you submit through the Site (Engage form fields, newsletter subscription, uploaded documents) is governed by the firm's Privacy Policy. By submitting information through the Site, you represent that you have the authority to submit that information and that submission does not violate any obligation you owe to any third party.

Barker and Barker Consulting does not accept unsolicited ideas, proposals, methodologies, or work product submitted through the Site as confidential. Unsolicited submissions of this kind are considered non-confidential and non-proprietary. 7. Disclaimers

7a. Site content is informational

Content published on the Site is provided for informational purposes only. It is not legal advice, tax advice, medical advice, engineering advice, or a substitute for a written consulting engagement with Barker and Barker Consulting. The firm's published briefings, past-performance pages, and capability pages reflect the firm's analysis of publicly available information and its accumulated professional experience. They do not constitute a specific recommendation for any specific reader's specific situation.

If you require professional advice specific to your organization, engage the firm directly through the Engage forms.

7b. No warranty on the Site

The Site is provided "as is" and "as available." Barker and Barker Consulting makes no warranty, express or implied, regarding the Site or its content, including no warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Without limiting the foregoing:

Where the Site cites data from third-party sources (Becker's Hospital Review, CMS, GAO, VA, HRSA, CDC, WHO, industry associations, journalism), the firm has taken reasonable steps to verify the citation at the time of publication. The firm does not warrant the accuracy of the third-party source itself.

8. Limitation of liability

To the maximum extent permitted by applicable law, Barker and Barker Consulting and its members, officers, employees, contractors, and agents shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your access to or use of the Site, whether based in contract, tort, or any other legal theory, even if the firm has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the firm's aggregate liability to you for all claims arising out of or in connection with your access to or use of the Site shall not exceed one hundred U.S. dollars ($100.00).

This limitation of liability does not apply to liability that cannot be limited under applicable law.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws principles. You agree that any dispute arising out of or in connection with these Terms or your access to or use of the Site shall be brought exclusively in the state or federal courts located in Waukesha County, Wisconsin, and you consent to the personal jurisdiction of those courts.
